1. Introduction

These Terms of Use (“Terms”) govern your access to and use of the careers website located at joinpss.com and related pages (collectively, the “Site”), which is operated by Project Support Services (“PSS,” “we,” “us,” or “our”). The Site is provided to help individuals learn about employment opportunities with PSS in California and to submit applications for open roles.

By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.

2. Eligibility

The Site is intended for users who are at least eighteen (18) years of age and who are legally able to enter into contracts in California. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization.

3. Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Your continued use of the Site after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Site.

4. Use of the Site

You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Site in any way that violates applicable local, state, national, or international law or regulation;
  • Attempt to gain unauthorized access to any systems, accounts, or data related to the Site;
  • Introduce malware, scrape or harvest data in a manner that overloads or harms the Site, or circumvent security features;
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity;
  • Use the Site to transmit unsolicited or unauthorized advertising or promotional material.

Job postings, descriptions, requirements, locations, compensation summaries, and other information on the Site are provided for informational purposes and may change without notice. We do not guarantee that any role will remain open or that descriptions will remain accurate at the time of your application.

5. Applications and employment

If you submit an application or other materials through the Site, you represent that the information you provide is accurate and complete to the best of your knowledge. You grant PSS a non-exclusive right to use, store, review, and process your application materials for recruiting, selection, onboarding, and related human resources purposes, including sharing with service providers that assist us in operating the Site and our hiring process (as described in our Privacy Policy).

Submitting an application does not create an employment contract or guarantee an interview, offer, or hire. Employment with PSS, if offered and accepted, is generally employment at will under California law, meaning either you or PSS may end the employment relationship at any time, with or without cause or notice, except as prohibited by law or as expressly agreed in a separate written agreement signed by an authorized representative of PSS.

8. Third-party links

The Site may contain links to third-party websites or services (for example, professional networking or social media). We do not control those sites and are not responsible for their content or privacy practices. Your use of third-party sites is at your own risk and subject to their terms and policies.

9. Disclaimer of warranties

THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW AND OTHER APPLICABLE LAW, IN NO EVENT WILL PSS OR OUR OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR THESE TERMS, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATING TO THE SITE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) ONE HUNDRED U.S. DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US, IF ANY, TO USE THE SITE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (THE SITE IS CURRENTLY PROVIDED WITHOUT CHARGE TO APPLICANTS).

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OR EXCLUSIONS; IN THOSE CASES, OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

11. Indemnity

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless PSS and our affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any rights of a third party.

12. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles. Subject to applicable law, you agree that the state and federal courts located in Riverside County, California, will have exclusive jurisdiction over any dispute arising out of or relating to the Site or these Terms, and you consent to personal jurisdiction in those courts.

13. General

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision does not waive that right or provision. These Terms constitute the entire agreement between you and PSS regarding the Site and supersede any prior agreements on that subject. Section titles are for convenience only.
